The Moral and Legal Aspects of Abortion After a Rape

Family

Rape is always a traumatic experience and unfortunately, so many the things that come after a rape, like filing a police report, having a rape kit done and describing the attacker can be just as horrible of an ordeal. Should a rape victim become pregnant as the result of the crime, this further complicates and exacerbates the situation. You may be wondering if there are any moral and legal issues that accompany having an abortion after the rape.

Legal Aspects

Although some states have tried to make abortion illegal, they have been unsuccessful in maintaining these laws. There are many skilled and dedicated sex crime lawyers who have been advocating for sex crime victims, their rights and their health. Some states have made abortion less accessible, but any pregnant woman can have an abortion in the US. Some states that have attempted to ban abortions made an exception for rape, while others did not.

Morality

Although abortion is a hot button issue, people have different morals. The question of whether abortion after a rape is moral or not is legally left up to the rape victim. As abortion, for any reason, is legal in all 50 states and the District of Columbia, if someone chooses to abort a rape pregnancy, they may do so, whether it is against their morals or not. If abortion is not in line with the victim’s morals, she is not required to go against her morals and terminate the pregnancy. Abortion is a choice offered to pregnant women in the United States.

What to Do If You’re the Victim of Rape

If you are the victim of a rape, you have several options available to you. The first thing you should do is go somewhere you know you will be safe, like your home or a friend’s home, a fire station or the hospital. If you want to hold someone accountable for the reape you will need to seek medical attention and file a police report. You will have a more complete rape kit if you do not change your clothing or bathe following the assault. If you are not comfortable with this, it is okay. You may wish to call the National Sexual Assault Telephone Hotline and speak with someone in your area who can help you process and make plans for next steps.

If you are concerned about the legal and moral aspects of rape, they are all pretty clear. If you have been raped or know someone who has been raped and is subsequently pregnant, you or they can have an abortion. If your morals and abortion do not align, there are other options, including adoption and raising the child. You didn’t have any say in your victimization, but what happens at this point is totally up to you. Whatever your choice, you will be able to find support. There are lots of organizations and support groups that can help you to heal and navigate your feelings.
