What to Do When Dealing with a Lawsuit

If you have never been sued before and somebody has served you papers, the chances are very good that you are feeling overwhelmed and worried right now. You need to know what to do for your first lawsuit, because while you may have sued somebody else before for negligent action, if you are on the receiving end of the papers then you need to make sure that you know what you’re doing. If the lawsuit pertains to your business, then you need to look at the steps below to know what to do.

  • Speak to a competent legal team. If you have been handed an envelope of papers, and you don’t have a lawyer on retainer already, you need to make sure you get one as soon as you can. You should not respond to anybody, post any comments anywhere, or do anything before you hire a lawyer. You should also not compromise on the lower that you do higher because it is obvious that an inexperienced lawyer is going to cost you more money overall. Do your due diligence here and make sure that you are choosing a legal team that understands how to deal with your issue.

  • Feel your feelings. If you have been sued for whatever reason, or your business is under threat, you need to give yourself a few days to feel angry. It’s going to feel like a punch in the gut, and the world is ending when your finances are about to be ruined. All of these feelings and any other feelings you may have are valid, but they are not the only thing to feel. The only way out of this is by going through and that means dealing with your fear and your emotions up front. Remaining productive and continuing to manage your business and you is not easy, but it’s something you have to do all through the lawsuit.

  • Surround yourself with support. When you are dealing with a lawsuit you need to make sure that you have people that you can talk to and rely on. Turn to support with your friends and your family outside of your business who will understand your mentality and help you get through it. Knowing that you have the support of your loved ones can really make a big difference to this burden, and your life will feel 10 times easier.

  • Start doing some research. If you have never been sued, then you need to know what comes next. Researching your options and getting to know what happens as a result of being sued will help you to be more informed throughout the case. There are so many options for you here, and it doesn’t have to be cut and dry as if your business is going to fold under the financial pressure. There are always options, and you can turn to your legal team to ask what they are.

  • Remain as calm as you can. It’s not easy to do when you’ve been served with papers, and you will feel distracted and throw off your game. It doesn’t mean that you are going to be able to get through this, it just means that remaining calm is going to ensure that you don’t blow up at the wrong time. Remain calm and wait for advice from your lawyer and you’ll be able to get through this.
